Information on data transfer to the USA and other non-EU countries

Among other things, we use tools from companies based in the United States or other non-EU countries that are considered insecure from a data protection perspective. When these tools are active, your personal data may be transferred to and processed in these non-EU countries. We must point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are required to disclose personal data to security authorities, and you as the affected individual have no legal means to defend yourself in court. Therefore, it cannot be ruled out that US authorities (e.g., the Secret Service) may process, analyze, and permanently archive your personal data for surveillance purposes. We have no influence over these processing activities.

Withdrawal of Your Consent to Data Processing

A variety of data processing operations is only possible with your explicit consent. You can revoke any consent you have already given at any time. This does not affect the legality of the data collection that occurred prior to your revocation.

Right to object to data collection in special cases; Right to object to direct marketing (Art. 21 GDPR)

If your data is processed based on Article 6(1)(e) or (f) of the GDPR, you have the right to object at any time for reasons arising from your particular situation. This also applies to profiling under these provisions. For details on the legal basis, we refer to this privacy policy. If you object, we will cease processing your data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing is necessary for the establishment, exercise, or defense of legal claims (Article 21(1) GDPR).

If your data is used for direct marketing, you can object at any time, including any related profiling. Once you object, your data will no longer be used for this purpose (Art. 21 para. 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, affected individuals have the right to lodge a complaint with a supervisory authority, particularly in the member state where they have their residence, their workplace, or the place where the alleged violation occurred. The right to complain applies regardless of other available administrative or judicial procedures as remedies.

Right to data portability

You have the right to have data that we process automatically based on your consent or to fulfill a contract provided to you or a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only occur if it is technically feasible.

Information about, correction and deletion of data

In accordance with applicable legal provisions, you have the right to request information at any time about your archived personal data, its origin and recipients, as well as the purpose of processing your data. You also have the right to have your data corrected or deleted. If you have any questions on this topic or other questions regarding personal data, please do not hesitate to contact us at any time.

Right to restriction of processing

You have the right to request the imposition of restrictions on the processing of your personal data. You can contact us at any time for this purpose. The right to restrict processing applies in the following cases:

If you dispute the accuracy of your data archived with us, we generally need some time to verify this claim. During this time, you have the right to request the restriction of processing your personal data.

If the processing of your personal data was/is unlawful, you have the option to request the restriction of the processing of your data instead of demanding the deletion of this data.

If we no longer need your personal data and you require it for the exercise, defense, or assertion of legal claims, you have the right to request the restriction of processing your personal data instead of its deletion.

If you have lodged an objection pursuant to Article 21(1) of the GDPR, your rights and our rights must be weighed against each other. Until it is determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data may only be processed – except for archiving – with your consent or for the establishment, exercise, or defense of legal claims, or to protect the rights of other natural or legal persons, or for important public interests cited by the European Union or a member state of the EU.

SSL and/or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the website operator, this website uses either an SSL or a TLS encryption program. You can recognize an encrypted connection by checking whether the address bar of the browser changes from "http://" to "https://" and also by the appearance of the lock symbol in the browser bar.

If SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

Rejection of unsolicited emails

We hereby object to the use of contact data published in connection with the mandatory information that must be provided in our imprint, to send us advertising and informational materials that we have not expressly requested. The operators of this website and its pages reserve the explicit right to take legal action in the event of unsolicited sending of advertising information, for example through SPAM messages.

Cookies

Our websites and pages use what is known in the industry as "cookies." Cookies are small data packets that do not harm your device. They are either stored temporarily for the duration of a session (session cookies) or permanently archived on your device (permanent cookies). Session cookies are automatically deleted once you end your visit. Permanent cookies remain archived on your device until you actively delete them or they are automatically removed by your web browser.

Cookies can be issued by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies into websites (e.g., cookies for processing payment services).

Cookies have a variety of functions. Many cookies are technically essential, as certain features of a website would not work without these cookies (e.g., the shopping cart function or the display of videos). Other cookies can be used to analyze user behavior or for advertising purposes.

Cookies that are necessary for the execution of electronic communication processes, for providing certain functions you wish to use (e.g., for the shopping cart function), or that are necessary for the optimization (essential cookies) of the website (e.g., cookies that provide measurable insights into the web audience), are stored based on Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing the necessary cookies to ensure the technically flawless and optimized provision of the operator's services. If your consent for the storage of cookies and similar recognition technologies has been requested, the processing is carried out solely on the basis of the granted consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG); this consent can be revoked at any time.

You have the option to configure your browser to be notified when cookies are set and to allow the acceptance of cookies only in certain cases. You can also exclude the acceptance of cookies in specific cases or generally, or activate the deletion function to automatically delete cookies when the browser is closed. If cookies are disabled, the functions of this website may be limited.

Which cookies and services are used on this website can be found in this privacy policy.

Server log files

The provider of this website and its pages automatically collects and stores information in so-called server log files that your browser transmits to us automatically. The information includes:

  • The type and version of the browser used
  • The operating system used
  • Referrer URL
  • The hostname of the accessing computer
  • The time of the server request
  • The IP address

This data will not be merged with other data sources.

This data is collected based on Article 6(1)(f) of the GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of the operator's website. To achieve this, server log files must be collected.

Contact form

If you send us inquiries through our contact form, the information provided in the contact form as well as any contact details specified there will be stored by us to process your request and in case we have further questions. We will not share this information without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR when your request is related to the performance of a contract or when it is necessary to take pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries directed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR), if requested; consent can be revoked at any time.

The information you entered in the contact form will remain with us until you request that we delete the data, revoke your consent to the archiving of the data, or the purpose for which the information is archived no longer exists (e.g., after we have completed our response to your inquiry). This is without prejudice to any legal regulations, particularly retention periods.

Inquiry by email, phone, or fax

If you contact us by email, phone, or fax, your request, including any resulting personal data (name, request), will be stored and processed by us to handle your inquiry. We do not share this data without your consent.

This data is processed on the basis of Art. 6 para. 1 lit. b GDPR when your request is related to the fulfillment of a contract or is necessary for the performance of pre-contractual measures. In all other cases, the data is processed on the basis of our legitimate interest in the effective handling of inquiries directed to us (Art. 6 para. 1 lit. f GDPR) or on the basis of your consent (Art. 6 para. 1 lit. a GDPR), provided that it has been obtained; consent can be revoked at any time.

The data you have sent to us in the context of contact inquiries will remain with us until you request their deletion, revoke your consent to storage, or the purpose of data storage no longer applies (e.g., after your inquiry has been completed). Statutory provisions - particularly legal retention periods - remain unaffected.

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland

The Google Tag Manager is a tool that allows us to integrate tracking or analytics tools and other technologies on our website. The Google Tag Manager itself does not create user profiles, store cookies, or conduct independent analyses. It merely manages and executes the tools integrated through it.

However, the Google Tag Manager collects your IP address, which may also be transferred to Google's parent company in the United States.

The Google Tag Manager is used based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on their website. If the corresponding consent has been obtained, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user's device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

Google Analytics

This website uses features of the web analytics service Google Analytics. The provider of this service is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics allows the website operator to analyze the behavior of website visitors. For this purpose, the website operator receives a variety of user data, such as pages visited, time spent on the page, the operating system used, and the user's origin. This data is summarized in a user ID and assigned to the respective device of the website visitor.

Google Analytics uses technologies that enable user identification for the purpose of analyzing user behavior patterns (e.g., cookies or device fingerprinting). The information collected by Google regarding the use of the website is typically transmitted to a Google server in the United States, where it is stored.

The use of these services is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. You can revoke your consent at any time.

The data transfer to the USA is based on the Standard Contractual Clauses (SCC) of the European Commission. Details can be found here:

https://privacy.google.com/businesses/controllerterms/mccs/

IP anonymization

On this website, we have activated the IP anonymization feature. As a result, your IP address will be shortened by Google within the member states of the European Union or in other states that have ratified the agreement on the European Economic Area before being transmitted to the United States. The full IP address will be transmitted to one of Google's servers in the United States and will only be shortened in exceptional cases. On behalf of the operator of this website, Google will use this information to analyze your use of this website, create reports on website activity, and provide the operator of this website with additional services related to the use of the website and the internet. The IP address transmitted by your browser in connection with Google Analytics will not be merged with other data held by Google.

Browser Plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link:

https://tools.google.com/dlpage/gaoptout?hl=en

For more information on the processing of user data by Google Analytics, please consult Google's privacy policy at:

Contract Data Processing

We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Newsletter Data

If you would like to receive the newsletter offered on the website, we need an email address from you as well as information that allows us to verify that you are the owner of the provided email address and that you agree to receive the newsletter. No additional data will be collected or will only be collected on a voluntary basis. For the management of the newsletter, we use newsletter service providers, which are described below.

Rapidmail

This website uses Rapidmail for sending newsletters. The provider is rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br., Germany.

The Rapidmail services can be used, among other things, to organize and analyze the sending of newsletters. The data you enter for the purpose of signing up for the newsletter is archived on Rapidmail servers in Germany.

Data analysis from Rapidmail

For analysis purposes, emails sent via Rapidmail are equipped with a so-called "tracking pixel" that connects to Rapidmail's servers as soon as the email is opened. This makes it possible to determine whether a newsletter email has actually been opened.

With the support of Rapidmail, we are also able to determine whether and which links in the newsletter message the recipient has clicked on. All links integrated into the email are so-called tracking links, which allow us to count your clicks. If you do not wish to allow analysis by Rapidmail, you must unsubscribe from the newsletter. We provide a link in each newsletter message to do this. Additionally, you can also unsubscribe from the newsletter directly on the website.

For more details on the Rapidmail analysis features, please follow this link:

https://de.rapidmail.wiki/kategorien/statistiken/

Legal basis

The data is processed based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke your consent at any time by unsubscribing from the newsletter. This does not affect the lawfulness of data processing operations that occurred before your revocation.

Retention period

The data you provided to us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter or the newsletter service provider, and will be deleted from the newsletter distribution list after your unsubscription. Data that is stored with us for other reasons will remain unaffected.

After you unsubscribe from the newsletter distribution list, your email address may be stored in a blacklist by us or the newsletter service provider if necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be combined with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR). The storage in the blacklist is unlimited.

You can object to the storage if your interests outweigh our legitimate interest.

Please consult the privacy policy of Rapidmail for further details at:

https://www.rapidmail.de/datensicherheit

Data processing

We have entered into a Data Processing Agreement (DPA) for the use of the aforementioned service. This is a contract required by data protection laws that ensures they process the personal data of our website visitors only based on our instructions and in accordance with the GDPR.

Google Maps

This website uses the mapping service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

In order to enable the use of Google Maps features, your IP address must be stored. Typically, this information is transmitted to one of Google's servers in the United States, where it is archived. The operator of this website has no influence over the data transmission. If Google Maps is activated, Google has the option to use Google Fonts to ensure a consistent display of fonts. When you access Google Maps, your browser loads the necessary web fonts into your browser's cache to correctly display text and fonts.

We use Google Maps to present our online content in an engaging way and to make the locations specified on our website easily findable. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If the appropriate consent has been obtained, the processing is carried out solely on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user's device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

The data transfer to the USA is based on the Standard Contractual Clauses (SCC) of the European Commission. Details can be found here:

https://privacy.google.com/businesses/gdprcontrollerterms/ and

https://privacy.google.com/businesses/gdprcontrollerterms/sccs/

Data processing

We use online conference tools, among other things, to communicate with our customers. The tools we use are listed in detail below. When you communicate with us via video or audio conferences on the internet, your personal data is collected and processed by the provider of the respective conference tool and by us. The conference tools collect all information you provide/access in order to use the tools (email address and/or your phone number). In addition, the conference tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants, and other "context information" related to the communication process (metadata).

In addition, the provider of the tool processes all technical data necessary for the processing of online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded, or otherwise provided within the tool, it will also be stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/instant messages, voicemail, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.

Please note that we do not have full control over the data processing procedures of the tools used. Our options are largely determined by the corporate policies of the respective provider. For more information on data processing by the conference tools, please refer to the privacy policies of the tools used, which we have listed below this text.

Purpose and Legal Basis

The conference tools are used to communicate with potential or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b GDPR). Furthermore, the use of the tools serves to simplify and expedite communication with us or our company in general (legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR). If consent has been obtained, the relevant tools will be used based on this consent; consent can be revoked at any time with effect from that date.

Duration of storage

Data that we collect directly through the video and conference tools will be deleted from our systems immediately after you request us to do so, revoke your consent for storage, or the reason for storing the data no longer applies. Stored cookies will remain on your device until you delete them. Statutory retention periods remain unaffected.

We have no influence over the duration of the storage of your data, which is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.

Used Conference Tools

We use the following conference tools:

Microsoft Teams

We use Microsoft Teams. The provider is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. For details on data processing, we refer to the Microsoft Teams privacy policy:

https://privacy.microsoft.com/en-us/privacystatement

Data processing

We have entered into a Data Processing Agreement (DPA) for the use of the aforementioned service. This is a contract required by data protection laws that ensures they process the personal data of our website visitors only based on our instructions and in accordance with the GDPR.

Handling of applicant data

We offer visitors to our website the opportunity to send us applications (e.g., via email, through postal services, or by submitting the online application form). Below, we inform you about the scope, purpose, and use of the personal data collected from you in connection with the application process. We assure you that the collection, processing, and use of your data is carried out in accordance with applicable data protection laws and all other legal provisions, and that your data will always be treated as strictly confidential.

Scope and Purpose of Data Collection

If you send us an application, we will process all associated personal data (e.g., contact and communication data, application documents, notes taken during interviews, etc.) as far as necessary to make a decision regarding the establishment of an employment relationship. The legal bases for this are § 26 BDSG according to German law (negotiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract negotiations), and – if you have given us your consent – Art. 6 para. 1 lit. a GDPR. You can revoke your consent at any time. Within our company, your personal data will only be shared with individuals involved in processing your application.

If your application leads to your hiring, the data you provided will be archived in our data processing system based on § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship.

Data archiving period

If we are unable to offer you a position, or if you decline a job offer or withdraw your application, we reserve the right to retain the data you provided based on our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months after the conclusion of the application process (rejection or withdrawal of the application). After that, the data will be deleted and the physical application documents will be destroyed. The retention serves particularly as evidence in the event of a legal dispute. If it is evident that the data will be needed after the 6-month period (e.g., due to a pending or threatened legal dispute), deletion will only occur once the purpose of further retention no longer applies.

A longer storage period may also occur if you have given your consent (Article 6(1)(a) GDPR) or if legal retention obligations exclude deletion.

Data processing through social networks

We maintain publicly available profiles on social networks. The individual social networks that we use can be found below.

Social networks like Facebook, Twitter, etc. can generally analyze your user behavior comprehensively when you visit their website or a website with integrated social media content (e.g., like buttons or banner ads). When you visit our social media pages, numerous data protection-related processing operations are triggered. In detail:

If you are logged into your social media account and visit our social media page, the operator of the social media platform may associate this visit with your user account. Under certain circumstances, your personal data may also be collected if you are not logged in or do not have an account with the respective social media platform. In this case, this data may be collected, for example, through cookies stored on your device or by capturing your IP address.

With the data collected in this way, the operators of social media platforms can create user profiles that store your preferences and interests. This allows you to see interest-based advertising both within and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device where you are or have been logged in.

Please also note that we cannot trace all processing operations on social media platforms. Depending on the provider, additional processing operations may be carried out by the operators of the social media platforms. Details can be found in the terms of use and the privacy policy of the respective social media platforms.

Legal basis

Our social media presence aims to ensure the maximum visibility on the internet. This is a legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR. The analysis processes initiated by social networks may be based on different legal grounds, which must be specified by the operators of the social networks (e.g., consent in accordance with Art. 6 para. 1 lit. a GDPR).

Responsibility and Enforcement of Rights

If you visit one of our social media pages (e.g., Facebook), we, along with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can generally assert your rights (access, rectification, deletion, restriction of processing, data portability, and complaint) both against us and against the operator of the respective social media portal (e.g., Facebook).

Please note that despite our shared responsibility with the operators of social media platforms, we do not have complete control over the data processing operations of these social media platforms. Our capabilities are determined by the corporate policies of the respective provider.

Storage duration

The data collected directly by us through our social media presence will be deleted from our systems as soon as the purpose for their storage no longer applies, you request deletion, you revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Legally mandated provisions - particularly retention periods - remain unaffected.

We have no control over the duration of storage of your data, which is stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g., in their privacy policy, see below).
